When Should You Start a Prenup in Florida?
Why starting early matters, even when state law does not prescribe the same timing rules as another jurisdiction.
Do not plan around the minimum
The best process leaves time for disclosure, drafting, negotiation, independent review, revisions, and execution without wedding-week pressure.
Timing rules are state specific
Florida does not use California’s seven-day rule as a universal prenup deadline. That does not make last-minute signing a good idea; voluntariness and proper execution still matter.
Build in time for financial disclosure
Complex portfolios, businesses, trusts, and real estate may take time to document and understand.
Leave room for real negotiation
A prenup is an agreement. Both parties should have enough time to evaluate proposed terms and request changes.
Legal starting point: Florida Statutes § 61.079. Florida has adopted the Uniform Premarital Agreement Act. A premarital agreement must be in writing and signed by both parties, and enforceability can involve voluntariness, unconscionability, disclosure, waiver, and knowledge of the other party’s property or financial obligations.
