Florida Prenup Requirements

The core legal and practical requirements to consider when preparing a prenuptial agreement in Florida.

Start with the formalities

A prenup should be prepared with the state’s execution requirements in mind from the beginning. Formalities can matter just as much as the financial terms.

Voluntariness and process

A rushed or pressured process can create avoidable enforceability disputes. Give both parties meaningful time to review, ask questions, negotiate, and obtain advice.

Financial information

Organize assets, debts, income, businesses, real estate, investments, trusts, and other material financial interests before drafting begins.

Use state-licensed counsel

State law differs materially. A lawyer licensed in the relevant state can address current statutes, cases, execution formalities, and the particular provisions being negotiated.

Legal starting point: Florida Statutes § 61.079. Florida has adopted the Uniform Premarital Agreement Act. A premarital agreement must be in writing and signed by both parties, and enforceability can involve voluntariness, unconscionability, disclosure, waiver, and knowledge of the other party’s property or financial obligations.
