New York Prenup Checklist

A practical checklist for getting organized before you meet with a prenup attorney.

Financial documents

Gather recent statements for bank, brokerage, retirement, loan, mortgage, and credit accounts, plus business and trust information where relevant.

Property and debt inventory

List real estate, businesses, investments, valuable personal property, expected inheritances, guarantees, and significant debts or obligations.

Goals for the agreement

Identify what each person wants to protect or clarify: premarital property, future earnings, businesses, support, estate rights, debt, or treatment of future purchases.

Process and timing

Know the wedding date, identify counsel early, allow time for disclosure and negotiation, and confirm the state’s execution requirements before signing.

Legal starting point: New York Domestic Relations Law § 236(B)(3). New York requires a marital agreement to be in writing, subscribed by the parties, and acknowledged or proven in the manner required for a deed to be recorded. New York does not use California’s seven-day rule, so state-specific execution formalities are especially important.
